“Russian Disinformation” Is The New “Racism”

Revolver News [h/t LRC] explains why, with the refusal of the media establishment to admit that it blatantly and concertedly lied about the legitimacy of the Hunter Biden laptop and dismissed it as Russian propaganda,  the “Russian disinformation” label has replaced “racism” or “sexism” as the state-of-the-art term in cancel culture…

Why? Revolver argues it is because national security is a reason that allows the harshest repressive measures.

Well, that has always been true.

Some twenty years ago, political dissidents or even just free-thinkers were labeled “domestic terrorists,” a label which also invoked national security.  Then there was the War on Terror and dissidents got called “Jihadis” or “Islamofascists”.

So  the “Russian disinfo” label is NOT some new line being crossed. It’s the same old tired ploy….and actually not nearly as effective as “public health hazard” which can get you into quarantine camp, have you forcibly injected with poisons, and hospitalized against your will. I’ll take jail over that.

Anyway, Revolver recommends the following:

1. Never believe the “disinformation” scam ever again, for any reason. The intelligence services have entirely forfeited any and all public trust on this topic. At this very moment, hundreds of Republican lawmakers, pundits, and D.C. creatures are being herded like cattle into supporting greater censorship of Russia, China, or anyone “supporting” them. This is a grievous blunder. Indeed, lower-level establishment flunkies and stooges will only have themselves to blame when these new powers are turned back against them. Of course, the ability to wield these tools like a weapon over a cowed populace is exactly the real purpose of expanding such powers in the first place.

[Lila: Now, hmmmm.  Whom would that help? Never is too strong. Do you mean to say no other country or power will ever utilize disinformation against us?  What if the WEF or the EU employs disinformation, may we say so? Baby, bathwater, etc.]

2. Take the news out of the press’ hands. In hindsight, it was clearly a mistake for Rudy Giuliani to try and carefully release the laptop’s contents through press outlets. The story trickled out too slowly, and it was too easy for the press and Big Tech to unite in simply shutting out the New York Post entirely. If the laptop’s entire contents had simply been uploaded online for anybody to read, a la Wikileaks, suppressing the story would have been much harder, verging on impossible.

[Lila: And if you do upload it online, who do you suppose allows visibility on the net? The material could lie there and not be read by anyone. Actually,  a couple of videos of Hunter were uploaded online and that’s where I saw them. That doesn’t seem to have made a difference. The point is the general public still assesses the credibility of information based on who puts it out: how credentialed or well-regarded or prestigious, not on the merits. Wikileaks itself was initially promoted via a massive concerted effort of all the major media organs….just search Wikileaks on this blog.]

3. Defund the intelligence state. America’s intelligence agencies have essentially gone rogue. They spied on the Trump campaign in 2016 and sabotaged President Trump internally from 2017 onward. They constantly deliver preposterous lies in the guise of “expertise”, which is then used to justify mass censorship and the stripping of Americans’ rights. Oh, and they’re the same group behind warrantless espionage and the Iraq War and so much else. The intelligence agencies have become one of the chief impediments to American liberty, and they have declared American nationalists, populists, and conservatives a de facto enemy class. Breaking the power of these agencies should be the primary political goal of all decent Americans in the years to come. A good blueprint for a future Republican presidency? Declassify everything, so agencies can no longer conceal their blunders, lies, and outright crimes under the cloak of “national security.”

JFK Assassination Obsession Unique To Libertarians?

Uh no, Mr. Burris,

I’ve been fascinated by it a long time….and aware that it was not the DEEP STATE but the NWO elites using their tool Johnson who assassinated Kennedy.

Left liberals who worship Kennedy are the premier group obsessed with the Kennedy assassination…….

Because they want to retain the myth of Camelot and understand how it was taken away from them.

Christians or conservatives don’t usually care much for Kennedy in the first place …or for Camelot…and place the cementing of control of the NWO much earlier, some with FDR, others earlier, with Wilson.

Libertarian analysis of this conspiracy ends up mythologizing Kennedy even more, which is hardly something a cultural conservative would want to do.

Besides, the whole analysis of the NWO COMES from Christian writers from a century and more back; their  ideas were imported, repackaged and reattached to a variety of non Christian writers whose view points were more consonant with that of the elites than Christianity.

I have patiently read through a good bit of the Christian literature on the subject and that’s where it emerges.

Still way ahead of you.

Libertarianism is a decent framework for contemporary politics. And any rationalization aka ideology that you can dream up for it after the fact.

It is not a particularly convincing framework to tackle anything else.

The teachings of Christ and the teachings of Murray Rothbard or Mises are incompatible in anything more than a superficial or temporary way.

They provide good cover for Christians who are embarrassed to profess Christianity publicly because it undermines their standing in academic and intellectual circles.

But to be a friend of this world is to hate Christ.

And to love Christ is to hate this world.

Just as one might be what is deemed a great patriot or freedom fighter and even highly moral, for conducting espionage on behalf of your own country, hacking other people’s private information, or perhaps, even more dreadfully, seducing a honey pot on behalf of the white hats, the fact is you cannot be a follower of Christ and do it.

At least, you might do it, but you would not be proud of it. You would look at it as an evil necessity and eat bread and water and flagellate yourself until the stink of it in your soul was gone. And even then you would shudder at the moral AIDS you had contracted and know that your spiritual health had been forever compromised.

Your seduction puts you only one step away from the sexual torturers of Abu Ghraib, who likewise instrumentalized their own genitals into weapons of war. They were uneducated youngsters, with  no one to tell them better. What is your excuse?

That is what undercover operations in the James Bond vs. Pussy Galore genre mean….they reduce genitals into weapons at the level of a Venus fly trap, and transform the human into the insect world.

But a vast number of people go along with such things, because we have all been conditioned by movies in the Cold War genre to accept that white and black hats differ only in their ends, not in the means they employ.

But that is ultimately as soul destroying a belief as the esoteric philosophies that were for many years my own temptation. Very likely more destructive.

Coming out of Babylon involves much greater effort than changing the color of the flag under which we do battle….libertarian or liberal or progressive…

Or American or Russian or Chinese.

It means fighting only for the cross, which is Christ.

Known to the secular world as Truth……

Not for an ideology.

Alleged Trump Sex Video: From 9-11, Grosvenor Gardens

An interesting factoid:

The infamous alleged fetish video involving Donald Trump and a Russian hotel bed in which the Obamas slept (details delicately withheld on our chaste blog) turns out to have been given to US intelligence officials by none other than Senator John McCain, whose own record is so dodgy it muddies the story even more.

We think the much bigger question than Obama’s bed is Trump’s. Who’s in it? How much in hock is he to Russia?

McCain, an alleged war-hero but documented fink,  was once a POW in Vietnam and, since I just watched “The Manchurian Candidate,” that raises all sorts of questions for me about his own motivations and agenda.

Second, the file on Trump was compiled by a 20 year veteran of MI6 (the British foreign intelligence service), Christopher Steele, who from 1990 until 2009 was also a spy in Russia.

2009 was the year a lot of intel operations, including that of Wikileaks, began operating.

So what did Mr. Steele do in 2009? He opened Orbis Business Intelligence, which compiled the video. Apparently, he was funded by Republican anti-Trump operatives.

Where is Orbis located?

At the commercial site of 9-11 Grosvenor Gardens in London.

Is this another Rothschild/NWO wink or merely coincidence?

If the former,  into which realm of reality, falsity, or some mixture of both, do we consign the video?

And who is  behind it?

Insane McCain, Trump himself, his handlers, the Russians, the financial cabal, the CIA, Mossad, the FSB? Or some combination of these?

And if this is an X-rated rerun of the Manchurian Candidate, with McCain as the brain-washed trigger-man, is it Mike Pence or Hillary Clinton, who is the intended beneficiary?

My bet is the latter.

 

Isis Embedded 4000 Gunmen Among Migrants?

We know now that ISIS has been aided and abetted by the CIA.

[This is from Wikileaks, so I am delinking it. It is not necessary to go to WL because there is ample whistle-blower testimony to the fact. Besides, common-sense will tell you as much, given the surveillance apparatus in use now and the known history of the CIA.]

We have claims of social-media revolutionaries embedded among the refugees.
 

Multiple unusual and unusually large military drills have been running concurrently this summer all over the world.

Jade Helm 15 is one of them, and it is running in the US in the south, emphasizing special operations inside enemy territory.

 

OSINT, espionage, & sedition

A university researcher wrote to me a week or two ago. He asked if I would be interested in a project studying Operation Mockingbird and the CIA’s past and continuing use of the news media (and of social media).

A little research into the researcher showed that he was involved in a website promoting the use of  OSINT.

OSINT is the graceless acronym the government bestows on something called open-source intelligence.

OSINT is public information similar to what this blog uses.

Not just media reports, but links on forums,  government data,  court documents, commentary at blogs and in discussion groups, social media postings.

As long as it’s not confidential (a lawyer’s privileged conversation) or obviously private (a home phone number or medical information), it’s all fair game.

Until “national security” gets involved.

Of course, “national security” is an elastic term that seems to include everything.

The empire’s desire for full-spectrum dominance makes anything in outer – or inner – space part of “national security.”

Now, until I encountered the term OSINT in the past few days, I‘d no idea that what I was doing by chance bears a resemblance to what a whole wing of the CIA specializes in.

I do it because I’ve generally found the major media unreliable (and uninteresting) and the alternative media, while far more interesting,  ideologically biased.

But there’s a catch.

OSINT can get an un-credentialed journalist or blogger into serious trouble.

How serious?

Wikipedia on the dangers of OSINT:

“Accredited journalists have some protection in asking questions, and researching for recognized media outlets. Even so they can be imprisoned, even executed, for seeking out OSINT.

Private individuals illegally collecting data for a foreign military or intelligence agency is considered espionage in most countries. Of course, espionage that is not treason (i.e. betraying one’s country of citizenship) has been a tool of statecraft since ancient times, is widely engaged in by nearly all countries, and is considered an honorable trade.”

So, well-paid mercenaries and meddlesome bureaucrats who provoke international conflicts and break domestic and foreign laws while  spying on foreign countries are patriots, while unpaid citizen-bloggers/journalists trying to deconstruct the dense fog  of corporate-state propaganda to help ordinary people should be shot.

Very rational.

That leads me back to the curious invitation in my mail-box.

If gathering open-source intelligence can in some circumstances be seen as  treasonous, then why the invitation?

Blogging from public sources is one thing. But blogging that is intended to inform an enemy might be another.

The OSINT web-site I saw gave me a hint by referring to an open-source “revolution.“

Long-time readers of my blog will probably know  how I feel about “revolutions,” especially those led by what I call techno-utopians.

And sure enough, in the last two weeks it seems that the 45-year-old meme of “open source revolution” has been revived.

Yes, 45 years. That’s how old this “cutting-edge” meme is.

Only now it’s migrated from the soft-ware community, where it began, to the intelligence community.

Going back, the term “open-source” was a spin-off from a community of “hackers” creating what was later called free software at an MIT artificial intelligence lab in 1971.

The word hacker here doesn’t mean anything criminal. It’s a positive word for people who take apart and improve on computer programs for the sheer fun of it and for the good of the public.

At least, that’s the self-portrait.

The developer of free software, Richard Stallings, later worked at Lawrence Livermore lab and won a MacArthur “genius” award.

Lawrence Livermore is a government lab devoted to science and research in the interests of national security.

The cypherpunk group, devoted to developing strong cryptography ,  was the group from which Julian Assange and Wikileaks emerged.

It  included one researcher from the Lawrence Livermore lab, as well as many senior people from Bell, MIT, and Sun Microsystems (among others).

Stallings himself is a strong supporter of free software.

He developed the “copyleft” approach to IP, which allows changes to be made to code by innovators, so long as each innovator in turn allows other users the same freedom.

Copyleft also allows people the freedom to commercialize their innovations.

Stallings is a strong supporter of the hacker collective Anonymous, seeing it as a kind of legitimate “street protest.”

The Guardian Stages Surveillance Theater

The Guardian is running a piece by Trevor Timm, of the Greenwald-Poitras-Snowden- associated Freedom of the Press foundation. (H/T to Scott Lazarowitz, LRC)

It’s about Stingray, a technology that lets the government locate and track you via cell-phone tower signals.

Timm  is correct to point out the privacy implications of the NSA’s meta-data collection, which has filtered down to local police departments.

Meta-data is data about communications that doesn’t include the actual content.

It’s the date, the address (from and to), the length of time, the location.

Very rich, if collected continuously.

All very well, but, as even Timm does admit in the Guardian, this technology has been around for a couple of years.

Yet, last year, in a piece at the Electronic Frontier Foundation, Timm wrote:

A few months ago, EFF warned of a secretive new surveillance tool, commonly referred to as a “Stingray,” being used by the FBI in cases around the country.”

Secretive and new? Really?

The Louisville Law Review says the Feds used the Stingray from 2006 on.

[The Stingray is really a brand that refers to a family of technologies, says the Review.]

Local police departments were using the Stingray as early as 2007 (seven years ago).

“Oakland’s Targeted Enforcement Task Force made 21 ”Electronic Surveillance [StingRay] arrests” in 2007, 19 in 2008, and 19 in 2009 for charges including robbery, kidnapping, attempted murder and homicide. Further records show employees receiving up to 40 hours in training on the technology.”

This was discussed in the major media, at least as far back as 2011.

At the cyber- security blog, Schneier on Security, a commenter in January 2013, called the Stingray “very old technology.”

And the Stingray is now old and very expensive technology, I’d actually be more woried by the likes of pocket picocells that hackers cobble together from COTS equipment for less than 200USD. “

A spy technology for under 200 bucks?

I’d be more worried by picocells too.

So, why isn’t the Guardian?

Or the EFF?

Or the Freedom of the Press Foundation?

Electronic Police States – Top Twenty Five

Cryptohippie, which seems to support Wikileaks and Assange, came out with its third and last global ranking for “electronic police-states” a few years ago.

I find Cryptohippie itself a bit “interesting.” Why did it issue only three rankings and why did the rankings stop in 2010?

There might be some innocuous reason for it, but these days it pays to subject everything to close scrutiny.

If the powers-that-be wanted to “warn” the population via a respected NGO, it would not be a “threat” but a public service, right?

In any case, Cryptohippie divides the world into black, red, orange, yellow, and green zones, in descending order of control.

Black indicates total control and only North Korea fell into that territory in 2010 .

The red zone (advanced police states) included the US, UK, Russia, China, and Europe.

India, Australia, and Canada fell into the orange zone (fast developing police states).

The yellow zone (laggards) included parts of Europe and Mexico. The green zone (relatively free but some control) included Brazil and parts of Europe and Asia.

India came in at 26 in 2010.

Surveillance Psychosis Theater

Yet another act in the ongoing theater of the International Surveillance State:  “Wikileaks names US cell-phone spy target as Afghanistan, claims Google”(h/t Wenzel@EPJ)

The protagonists are well-known by now:

Wikileaks, Laura Poitras, Glenn Greenwald, Edward Snowden,  and Paul Watson (from Infowars, Alex Jones’ site).

They’ve already established their “street cred” (credibility at the grass-roots) with their activism, so their words are taken at face-value:

Earlier this week, Pierre Omidyar’s national security blog, The Intercept, reported that the US is recording all telephone calls made in and out of the Bahamas and one other unnamed country.

The story, co-bylined by Ryan Devereaux, Glenn Greenwald and Laura Poitras, explained that the Intercept had decided not to name that second “country X” due to the risk of increased violence in response.

As I wrote at the time, this decision prompted a furious response from former allies Wikileaks, which “condemn[ed] Firstlook for following the Washington Post into censoring the mass interception of an entire nation.”

Upping the stakes, Wikileaks also promised to name the redacted country within 72 hours.

Late last night the organization made good on its promise, issuing a statement claiming that “country x” is Afghanistan…

“Country X”! I’m surprised Greenwald didn’t put on a V for Vendetta mask and hiss “Psssst” from the bowels of a seedy bar.

As I’ve written here and here and here and here, and even back in 2005  in “Language of Empire,”  the government has been spying on all our calls and emails, without a warrant for a while now.

Even the mainstream press has reported this a long time ago.

That fearless dissident voice, The New York Times, published the following only a decade ago:

“Bush lets US Spy on Callers Without Courts,” James Risen and Eric Lichtblau, NY Times, December 16, 2005.

Let me call your attention to this line:

While many details about the program remain secret, officials familiar with it say the N.S.A. eavesdrops without warrants on up to 500 people in the United States at any given time. The list changes as some names are added and others dropped, so the number monitored in this country may have reached into the thousands since the program began, several officials said.

Except for the suspiciously low number of people the government admits to targeting,  what did this piece really hide?

Here is a leading establishment organ substantiating what activists and immigrants have known since 9-11:

Every call overseas, every email, is subject to government monitoring.

Now, I don’t know what other people take to be monitoring. But, by 2004 many immigrants like me were generally aware that the government was listening to all our calls and emails abroad.  We even joked about it.

It was in 2010, when I was browsing Cryptome’s archives, that I realized that calls and emails directed abroad were also being taped and archived.

That part, I admit, was a shock.

DURGA-RIOT OR “SIKH SPRING” FOR INDIA?

What was the significance of several news reports on the Khobragade story showing an Indian woman with multiple arms on the posters of domestic workers protesting the treatment of Khobragade’ maid?

The female icon with multiple arms in Hinduism is the goddess Durga, who represents the Divine Female (feminine energy) or Shakti.

[This the Hindu equivalent of Shekhinah in Judaism.]

Shakti is the consort of Shiva, the third person of the Divine Trinity in the Hindu pantheon.

Durga is the motherly form of the Divine Feminine, while the fierce form of the Divine Feminine is Kali.

Early on in the Khobragade story, a video representation of the arrest appeared on the net. It was later removed.

The video was an animation of the arrest, in which, as in the news reports, Khobragade kept turning into a multi-armed figure reminiscent of the Goddess Kali:

“The one-and-a-half-minute spoof has been posted by a group called “Next Media Animation TV. And though not everyone will be amused by the fact that the sari-clad Khobragade keeps turning into a Goddess Kali-like entity, the idea seems essentially to tell the basic story of the row wittily. Subtitles include one that goes “US not sari”.

Next Media Animation is an animation company in Taiwan.

It is run by a former Pentagon analyst, Mark Simon, from Virginia, headquarters of US intelligence and of the government-subsidized electronic snooping industry. [See below.]

It is a subsidiary of Next Media, a Hong Kong- based media conglomerate that creates humorous animations of news events.

Next media is the creation of serial entrepreneur Jimmy Lai and it is the largest media group in Hong Kong.

Jimmy Lai is known as the “Rupert Murdoch of Asia” for bringing in a flashy, tabloid-style of media into Asia. (Added: Jan 20, 2014)

Lai owns the biggest media operation in Hong-Kong.

Lai is highly critical of the Chinese government for its human-rights violations and lack of democracy, which has got wide coverage in propaganda outlets, like the BBC. (Added: Jan 21, 2014)

He has been targeted because of this, it is reported.

Lai’s position on China seems close to the position of the US State Dept. A further nexus between Lai and the West is the Catholic church. Lai is said to be a devout Catholic.

Durga is not only a significant icon in the Hindu pantheon, she has also been used to represent the nation of India, more specifically,  PM Indira Gandhi, who was famously painted as Durga in a portrait by a Muslim artist.

Indira Gandhi was in charge of Operation Blue-Star, to put down Sikh militancy in 1984. She was later assassinated by one of her own guards, a Sikh, in retaliation for Blue-Star.

The quadruple significance of Durga (as representing feminine energy, Hinduism as such, the Indian nation, and Mrs Gandhi) suggests the Devyani episode was a carefully planned operation, not a random event.  It also suggests the political motivations at work.

CONCLUSION:

Jimmy Lai seems to be an outlet for CIA disinformation and psyops.

“Lai had made donations of nearly $8 million over five years to pro-democracy groups and individuals — and that [Mark] Simon, as head of his private office, handled the payments.”

“Simon, who spends most of his time in Taiwan, where he runs Next Media’s animation unit, dismissed the whole affair as a “sloppy farce.”

NEWS REPORT: This interview with Lai in the New York Times mentions a video made by Next Media that showed Osama Bin Laden being urinated on and raped in hell.  Lai says the video was an “accident” by young employees.

Conspiracy by the US State Department, NGOs, and US Embassy in India

(Durga Riot and Sikh Spring for India?)

The Indian nanny-gate conspiracy is the latest episode in the US State Department’s  machinations in India.

Those machinations are apparently entailed by the Asian Pivot strategy enunciated by US President Barack Obama in 2011, to use the Indian sub-continent to contain China and project US power in Asia.

As part of this strategy, senior members of the US State Dept are reported to have orchestrated a case against a senior Indian diplomat to high-light the US-UN Anti-Trafficking agenda.

This was done over several months in 2013, in co-ordination with the highly publicized global Modern Slavery campaign promoted by the Corporate/CIA/NGO  establishment, along with labor unions (AFL-CIO) and philanthropic foundations, like Walk Free, the creation of an Australian billionaire.

Anti-trafficking and modern slavery are intended to provide the “humanitarian” case for UN intervention into a country.

For that reason, it’s important to remember who represents the US in the UN.

The US Ambassador to the UN is Samantha Power, a noted proponent of humanitarian intervention who is married to Cass Sunstein, Obama’s information czar.

Sunstein is infamous for advocating “cognitive infiltration” into dissident groups.

Samantha Power was directly lobbied by Freedom Network (anti-trafficking NGO) to support the anti-trafficking agenda early on in the Khobragade story (see below).

All this is obvious.

What is less obvious is that Nanny-gate seems to have been orchestrated in coordination with (or in connivance with) a radical Sikh separatist (Khalistani) group that has been pushing Sikh-genocide claims against the Indian government in the US, UK, and Canada.

These genocide claims have been pushed most strongly by the group, Sikhs For Justice, based in New York.

In Nanny-gate, an analysis of the time-line of events (see below) suggests that Sikhs For Justice was acting in concert with the US court system in New York and with the NGO behind the nanny, Safe-Horizon, also based in New York.

The time-line buttresses the argument that the Devyani Khobragade strip-search was a planned event in the unfolding drama of a Color Revolution in India.

Color Revolutions use propaganda, covert (black) operations, espionage, provocations, and human-rights claims to destabilize and undermine/destroy national sovereignty to precipitate the balkanization of a region.

Examples of assault on Indian sovereignty:

Item: The custodial rape on in December, 2013, of a senior Indian diplomat, formerly consul to Pakistan, is in gross breach of the Vienna Convention.

Item: The T3 trafficking visa granted to Sangeeta Richard and her family, circumvented the Indian judiciary, which had a non-bailable warrant out for her arrest for extortion and theft. The exfiltration of Philip Richard and their two children from India was also illegal under international and Indian law. Both actions also violated US law.

Item: The recent case (January 2014) of alleged rape, in which the Danish victim is planning to use a Danish medical examination, even though Delhi police have found no evidence of rape.

This seems to be part of an ongoing UN-sponsored “Rape Crisis” hysteria in Delhi.

Summary:

Events are being orchestrated to build a public case of India as a “failed state” lacking sovereignty, de facto and thus de jure.

Sangeeta Richard leaves without notification sometime between June 21and 23 2013.  The Indian government revokes her passport with effect from June 22. K informs the Office of Foreign Missions (June 24) who tells her to file a report with the NYPD, which initially refuses, but on written request files a report on June 25 and then closes it, stating that Sangeeta was missing.

Sangeeta reportedly lives with strangers and a Sikh temple in New York. She later arrives at Safe Horizon, which puts her in touch with the State Dept.

JULY 2013

On July 1 Khobragade receives a threatening call from an anonymous female attorney asking for a change in visa status enabling Sangeeta to work outside the Indian mission and for compensation for 19 hours a week of work.Khobragade refuses to negotiate and asks for the person’s identity, which is refused.

The call is reported to the NY Police Dpt and the Office of Foreign Missions a request is made to trace the call on July 2. On July 5, a complaint is made to the NYPD of aggravated harassment, involving extortion and blackmail.

Indian officials inform the US Embassy in India and the State Dept in DC.

On July 8,  Khobragade and several consular officials meet Sangeeta at the offices of Access Immigration, where Sangeeta asks for $10,0000, for her official passport to be changed to a personal one, and for a change in visa status allowing her to work in the market.  Indian officials tell her compensation will be payed before she leaves, but she has to return to India since her passport has been canceled.

There is an altercation and Access calls the police, which escorts Sangeeta away.

On Jul 19, Sangeeta’s husband Richard, a driver in the Mozambique embassy, files a petition in Delhi court alleging that the Indian govt has held his wife in police custody and that she has been enslaved in New York. He claims that Uttam Khobragade has threatened him with dire consequences should complain.

The petition is withdrawn 4 days later.

NEWS REPORT: The Indian Supreme Court reinstates a colonial-era ban that criminalizes homosexuality, although no one has ever been prosecuted under it.

Under USC Title 28, Sec. 1746, criminal charges of visa fraud (maximum of 10 years in jail) and perjury (maximum of 5 years) are filed against Khobragade by the US State Dept Bureau of Diplomatic Security on Dec 11, 2013 and a US Magistrate judge issues an arrest warrant.

Officers of the Diplomatic Security Services arrest Khobragade on criminal charges on Dec. 12, 2013 at 9.30 AM  after she drops of her children at school in Manhattan. She is taken to the courthouse at noon.

Female agents of the US Marshals conduct a strip-search in private (including cavity inspection but not probe) that is recorded on camera for security.

She was repeatedly DNA swabbed and “held with prostitutes and drug-addicts” according to her account.

She was produced hand-cuffed before a magistrate at 4 PM and released on a $250,000 recognizance bail on the same day, Dec. 12.

On December 20, a number of rights groups protested against the alleged treatment of Sangeeta Richard in front of the Indian Embassy in New York.

The protesters included Safe-Horizon (whose attorney Dana Sussman was representing Richard), the National Domestic Worker’s Alliance, Damayan Migrant Workers Association, the National Guestworker Alliance, and the National Domestic Workers’Alliance. Also present was the Break the Chain campaign.

The Democratic Youth Federation of India, a left-wing group, protested Khobragade’s arrest in Chennai, outside the US consulate on Dec 20.

Communist Party of India members scuffled with police in New Delhi in protest near the American center on the same day.

Earlier in the week Congress party members protested as well.

ITEM:  US LEGAL POSITION IN KHOBRAGADE ARREST IS WRONG

1. The illegality of the grant of the T-3 Visa to Sangeeta Richard

A T-3 visa is only granted for trafficking crimes, not for labor exploitation. There were never any trafficking charges brought against Khobragade, despite the media’s hype and propaganda.

2. The evacuation of the Richard family comprised multiple violations and frauds committed on the Indian legal system, US law, and international law.

The “evacuation” of  Sangeeta’s husband, Philip Richard, and their two children from India while there was an outstanding non-bailable warrant for the arrest on extortion and theft charges of both Sangeeta and Philip, was a direct obstruction of justice and in contempt of the Indian court that issued the warrant.

The flight also constituted an act of trafficking under international and US law and an act of visa fraud under US law.  The tickets for the Richard family were purchased fraudulently, under Indian tax law.

3. Under Section 3, Article 41 of the Vienna Convention 1963, the US arrest and strip-search was illegal

“If criminal proceedings are instituted against a consular officer, he must appear before the competent authorities. Nevertheless, the proceedings shall be conducted with the respect due to him by reason of his official position and, except in the case specified in paragraph 1 of this Article, in a manner which will hamper the exercise of consular functions as little as possible.”

4. The strip-search was also in violation of the US Marshals standards for the treatment of foreign diplomats:

IT IS IMPORTANT THAT LAW ENFORCEMENT and judicial authorities of the United States always treat foreign diplomatic and consular personnel with respect and with due regard for the privileges and immunities to which they are entitled under international law. Any failure to do so has the potential of casting doubt on the commitment of the United States to carry out its international obligations or of negatively influencing larger foreign policy interests. As stated above, however, appropriate caution should not become a total “hands off ’ attitude in connection with criminal law enforcement actions involving diplomats (p.16).

5. Under the Vienna Convention the US has no jurisdiction over Khobragade’s labor contract with another Indian citizen in her household on an India government passport:

“Consular officers and consular employees and members of their families forming part of their households shall be exempt from all obligations under the laws and regulations of the receiving State in regard to the registration of aliens and residence permits.”

6. US Bureau of Diplomatic Security agent Mark J. Smith misread the visa application form that is alleged to be fraudulent.

The sum $4500 was not the maid’s intended/required salary, as the major media repeatedly stated. It approximates the diplomat’s salary but is in excess of her official salary.

7. Sangeeta Richard, not Khobragade, filled out and signed the visa application and was party to both written contracts as well as to the oral contract.  She was educated, literate, and had multiple close family ties with the very agent in charge of anti-trafficking (the Bureau of Diplomatic Security Chief Wayne May, who employed her in-laws), so she cannot plead ignorance or coercion.

Richard was a government employee, like Khobragade, on a government passport.  She was subject to a non-bailable warrant issued by an Indian court for extortion and theft.

Her exfiltration amounted to subversion of the Indian judiciary by the US Embassy.

That would violate both Indian law and the Vienna Convention governing diplomatic relations, 1963.

The conspiracy to spirit out Richard included the following senior US embassy officials who all employed Richard’s immediate family (mother-in-law and father-in-law) over a period of at least 10 years:

That request is also corroborated by Richard’s later request for a visa/passport change and her subsequent refusal to return to India. Richard:

“Because of this treatment, I requested that I return to India but that request was denied,” Richard said in a short, cryptic statement that largely served to glorify Safe Horizon’s role in the episode than throw any great light on her differences with the diplomat and how it widened.

[Lila: The govt. of India canceled Richard’s official passport when she absconded from the Khobragade household, so her” request to return” is a bogus claim. Richard was obliged to return. It was because she didn’t want to return to India that she trumped up a trafficking case against her employer. At least, that is how the evidence looks to me.]

Bharara’s bogus charge against Khobragade that she confiscated the maid’s passport

Sangeeta Richard’s BLUE (personal) Indian passport became invalid once she had traded it in for her WHITE (official) passport.

The WHITE (official) passport was revoked by the Indian Government as soon as Sangeeta stopped working for Khobragade.

That was a Government of India action. It was not an action taken by Khobragade.

Meanwhile, Preet Bharara charged 49 Russian diplomats with Medicaid fraud and yet let them go, claiming they had diplomatic immunity. Actually,  some of them only had consular immunity, like Khobragade, and, furthermore, were junior to her.

Still further, Russian President Vladimir Putin banned Bharara from entering Russia for “biased and politically motivated” prosecution of its citizens.

Compare that to the tame response of the Indian government, a response that was nonetheless excoriated and ridiculed in the Indian press.
